Error to Wayne; Codd, J. Assumpsit by St. Joseph’s church against the city of Detroit to recover back taxes paid under protest. Judgment for plaintiff. Defendant brings error.

This is an action in assumpsit to recover certain general city taxes assessed upon certain real estate of the plaintiff for the year 1913, and paid under protest by the plaintiff. There are no disputed facts in the case. They were agreed, by stipulation filed, to be as follows:
“Plaintiff is an Episcopal Church, organized under the .laws of the State of Michigan, in the year A. D. 1887, for purposes of public worship, and has continuously conducted religious services from the date of its organization down to the present.
