Stovall Building Supplies, Inc. filed a complaint to foreclose a materialman’s lien and to collect on the open account of Dale Shope (“the builder”) for materials supplied for construction of a house on real property owned by Robert L. Peterson and Gertrude J. Peterson. The Petersons filed a third-party claim against their construction lender, First Clayton Bank & Trust Company (“the bank”), alleging the bank breached contractual and fiduciary duties in disbursing loan proceeds for construction of a house.
