CLARK, Circuit Judge.

The District Director of the Immigration and Naturalization Service for the New York District appeals from a final order of the District Court sustaining a writ of 'habeas corpus and directing the conditional release of the relator after twenty-one months’ custody on Ellis Island. The order was entered after respondent had declined to produce certain information called for by the judge in a preliminary decision, D.C.S.D.N.Y., 101 F.Supp. 66. From the facts it appears that Mezei, the relator, was born on Gibraltar in 1897 and thus is a native of Great Britain. He was…
