Petitioner is a lieutenant in the uniformed force of the Police Department of the City of New York. In July, 1S42, he competed in a promotion examination for the position of captain conducted by defendants, members of the Municipal Civil Service Commission of the City of New York. For the branch of the examination entitled “ Record and Seniority ” petitioner sought a credit of. 1.5% granted candidates for “ Participation in battle.” If his claim had been approved .his grade would have been increased to a passing mark and he would have been entitled to placement on the eligible list.
