Appellant, Joseph W. Middleton, (“Middleton”) appeals his conviction after a bench trial for the Class B felony of possession of a controlled substance with intent to deliver, § 195.211, RSMo Cum. Supp.1998, and the Class C felony of possession of a controlled substance, § 195.202, RSMo 1994. He was sentenced to concurrent terms of eight years for intent to deliver and five years for possession, to be served in the Missouri Department of Corrections.
