The grounds are that a marketable title cannot be given because of fatal defects in the proceedings. The action is for the partition of certain premises in Albany, N. Y. It was commenced on November 17, 1925. Interlocutory judgment was rendered on November 1,1927. The sale was on February 15, 1928. The sum of $68,100 was the bid and ten per cent was paid down. The deed was to be delivered on March 15, 1928, but the sale was not confirmed until April 14, 1928.
