PARKER, Justice.

Defendant was indicted 30 January 1995 for first-degree murder and felonious child abuse. In October 1995 he was tried capitally and found guilty of first-degree murder on the basis of torture and under the felony murder rule. He was also found guilty of felonious child abuse. Following a capital sentencing proceeding, the jury recommended a sentence of life imprisonment; and the trial court entered judgment accordingly.
