GIVAN, Chief Justice.

In the trial court a jury rendered a verdict in favor of appellee Crist and against appellant Robert Williams, finding appel lant liable for injuries sustained by appellee Crist in an automobile accident in which Crist was a passenger in Williams' vehicle.

The Court of Appeals, 476 N.E.2d 588, reversed the trial court and remanded the case with instructions to enter a judgment in favor of Williams. We grant Crist's petition to transfer to this Court, set aside the decision of the Court of Appeals and affirm the decision of the trial court.
