Various points have been raised and ably argued in this case, but in the view which this court takes ■of the facts, we are relieved from the necessity of examining at any considerable length, the questions of law raised.

It is alleged in the bill that in October, 1845, Allen Cadwallader being indebted to the complainant in the sum of thirteen thousand five hundred dollars, as evidenced by bond, did, in writing, for the purpose of securing the payment of said bond, assign over to Ferdinand Suydam for the use of complainants, five undivided eighth parts of the steamboat “ Belle Zane,”…
