Clarke, J.:.This is an appeal from a judgment of the Special Term dismissing the complaint in an equity action brought to determine the ownership of an award, made by the board of assessors of the city of New York for consequential damages sustained- by a plot of five lots situated on the south side of West Ninety-sixth street,-'between ¡Riverside drive and West'End avenue, in. the borough of Manhattan, by reason of the elevation of the grade of Riverside drive by the construction of a viaduct over West Ninety-sixth street.
