The facts in this case proved by direct evidence are: That. William James, at his death, owned one hundred shares of the capital stock of the Mechanics National Bank of Newark; that he died in January, 1881, leaving a will, in which he named his widow, Elizabeth James, George F. Tuttle and Oscar F. Baldwin as his executors, who, in February, 1881, took out letters testamentary upon his estate; that then, and for many year’s before, and afterwards, till its close on October 31st, 1881, Baldwin was cashier of the bank, and during a period of…
