Defendants-appellants, the New York City Police Department (“NYPD”) and its Commissioner, Howard Safir (collectively the “City”), appeal from the July 30, 1997, order of the United States District Court for the Southern District of New York (Sidney H. Stein, District Judge), enjoining the enforcement of NYPD Patrol Guide Procedure 114-8 (the “Procedure”), which restricts officers’ public statements regarding police department matters.
