Appeals (1) by permission, from an order of the County Court of Clinton County (McGill, J.), entered March 5, 2002, which denied defendant’s motion pursuant to CPL 440.10 to vacate the judgment convicting him of the crime of murder in the second degree, without a hearing, and (2) by permission, from an order of said court (Lawliss, J.), entered October 1, 2003, which denied defendant’s motion pursuant to CPL 440.10 to vacate the judgment of conviction, after a hearing.
