The plaintiffs brought this action upon two single bills, commonly called sealed notes, for one thousand dollars each, signed by the defendant, Napier, in the firm-name of-Young & Napier. The defendant, Napier, put in no answer, and judgment by default was taken against him. The defendant, Young, answered, and while admitting the partnership between himself and Napier, denied his liability on the notes, alleging that they were executed by Napier without his knowledge or authority.
