Hetten, one of the appellants, was appointed his deputy to act for him in the counties of Comal and Hays. This appointment was made on the 27th day of April, 1867, and on that day Hetten, as principal, executed his bond to Lane for the faithful performance of his duties as deputy, with Theodore Kcester, John F.
