This is a suit by the owner of real estate to have certain sidewalk paving liens erased from the mortgage records. The petition for the writ of mandamus alleges that more than ten years have expired since the inscription of said mortgages and that, under the provisions of Act No. 46 of 1918, he is entitled to have said inscriptions erased. The recorder of mortgages answered, pleading the unconstitutionality of the act for the reason that it violates section 15 of article 4 of the Constitution of Louisiana of 1921 and section 10 of article 1 of the Constitution of the United States.
