Proceeding pursuant to CPLR article 78 (transferred to this court by order of the Supreme Court at Special Term, entered in Albany County) to review that portion of a determination of the Industrial Board of Appeals which affirmed a notice of violation and order to comply of the Industrial Commissioner directing petitioner to take certain corrective action with regard to mine openings on petitioner’s property.
