HITZ, Associate Justice.

The plaintiff, a licensed real estate broker, brought this action to recover a commission of $490 on a sale of real estate alleged to have been negotiated by him for the defendant. The trial judge found upon (lie evidence that the plaintiff was not the procuring cause of the sale, and entered judgment for the defendant, from which this appeal was taken.
