delivered the opinion of the court:

Defendant was convicted in June, 1973, of involuntary manslaughter (a Class 3 felony) and reckless conduct (a misdemeanor), after a jury trial in the circuit court of Kane County. He was sentenced to a term of from 1 to 3 years on the manslaughter conviction only.

The victim of both offenses was Helen Bowman, a 77-year-old patient who had been confined at Elgin State Hospital for 11 years where she died on August 25, 1971, at 11:45 p.m. The indictment, returned on January 2, 1973, charged that defendant committed the offense…
