MEMORANDUM OPINION AND ORDER DENYING MOTION TO DISMISS

THIS MATTER comes before the Court on the Board of Education of the Española Public Schools’ Motion to Dismiss Plaintiffs Complaint (Doc. 3) and Memorandum in Support (Doc. 4). A hearing was held on this motion on June 29, 2011 at 1:30 p.m. Defendant Board of Education of the Española Public Schools (“District”) seeks dismissal of this lawsuit for failure to comply with the applicable statute of limitations.
