In this action, which is before this Court on consent pursuant to 28 U.S.C. 636(c), plaintiffs Next Generation Technology, Inc. ("NGT") and Puspita Deo ("Deo") (collectively, "Plaintiffs") challenge, under the Administrative Procedure Act ("APA"), 5 U.S.C. §§ 701 et seq. , the final decisions of the United States Citizenship and Immigration Services ("USCIS"), revoking its approval of an H-1B visa petition filed by NGT on behalf of Deo and denying NGT's subsequently amended petition.
