OPINION AND ORDER

EDELSTEIN, District Judge:

This is a diversity action for a money judgment based on three alternative theories: breach of contract, account stated, *36and goods sold and delivered. A default judgment was entered in this Court on January 7, 1986. Plaintiff sought to execute on the judgment in the District Court in Maryland and on or about March 26, 1986, a Writ of Garnishment was served upon Maryland National Bank restraining defendant’s bank account.

Defendant seeks to vacate the default judgment and to dismiss the action based on improper service of process. The motion is granted…
