WALTERS, Chief Judge.

During the robbery of a grocery store in Nampa, Idaho, in February 1981, the store owner was shot and killed. Subsequently, two brothers, David Zynn Wilson and Kelly Brian Wilson, were charged with first degree murder, robbery, burglary and the use of firearms in the commission of those crimes.

David Wilson pled guilty to first degree murder, robbery and use of a firearm. He was sentenced by the district court to the custody of the state Board of Correction. He received a determinate, fixed life term for the crime of first degree murder. He was sentenced also to a…
