This is a proceeding pursuant to CPLR article 78 for a judgment reviewing and annulling a determination that the petitioner, an assistant principal, is not entitled to a line-of-duty accident disability pension. The Corporation Counsel, as the respondent’s counsel of record, has cross-moved for an order dismissing the petition as premature since the challenged determination was one made only by the Medical Board of the Teachers’ Retirement System without any action by the retirement board of the system.
