COMBS, Justice.
This is a suit on an accident insurance policy for disability benefits amounting to $1,300, and for 12 per cent, penalty and $500 attorney’s fee. We will refer to the appellant as plaintiff and -the appellee as the insurance company.
On March 31, 1920, while traveling on a passenger train, the plaintiff received an injury to his left eye. The eye was treated by a specialist in an attempt to save the sight of it, but, on June 24, 1921, the eyeball was removed.
