RAY, Justice.

This is a workmen’s compensation case in which the trial court granted a summary judgment for the appellee Texas Employers Insurance Association. Appellant (plaintiff) Lee Roy Hubbard brought suit against Texas Employers Insurance Association alleging that he was injured on the job at Lone Star Steel Company on May 12, 1970. Appellee insurance company contended that appellant did not file his claim for workmen’s compensation with the Texas Industrial Accident Board until August 30, 1971, a period of approximately fifteen months after appellant was injured.
