Affirming.

Frank Davidson and bis son, Curt Davidson, were indicted in tbe Perry circuit court for tbe wilful murder of Rufus Herd. On tbe trial of tbe case tbe jury returned tfye following verdict:

“We tbe jury do agree and find tbe defendant Frank Davidson guilty, and fix bis punishment in tbe state penitentiary for tbe period of bis natural life. “J. D. Colwell.
*416“We the jury do agree and find the defendant Curt Davidson guilty of manslaughter, and fix his punishment in the state penitentiary for the period of twenty-one years. “ J. D. Colwell.”
