During the nights of November 1 and 2, 1960, Butte County Sheriff’s deputies, as a part of a raid upon, and roundup and arrest of, narcotic addicts and sellers, went to the home of appellant and demanded entry. Appellant, after some preliminaries, opened the front door, admitting the officers. Appellant was put under arrest and a search was made of the premises, both without a warrant. During this search part of a marijuana plant, marijuana seeds and two so-called “crutches” (devices said to prolong smoking of a marijuana cigarette) were found.
