Appellant was indicted by the Montgomery County Grand Jury on August 8, 1975, on three counts:(1) Inciting to a felony, bribery;(2) Inciting to a felony, attempted bribery;(3) Accepting a bribe.

The State elected to go to the jury on Count I only, and appellant was found guilty thereon and sentenced to three years in the penitentiary.
