This action was brought by the plaintiff upon the 5th day of December, 1893, to recover damages alleged to have been sustained by reason of his having been wrongfully ejected from a passenger car on defendant’s railroad at Reno, Ñev., on April 3, 1893. The case was tried before a jury, and a verdict rendered in favor of plaintiff for §1,700. Defendant moves for a new trial upon the ground that the verdict is so excessive as to indicate passion, prejudice, and bias upon the part of the jury.
