This case Jjresfents' 'an 'unusual question. Posey sued the -appellee in thet justice court of Carson county tb -recover- indebtedness alleged tO' be dUe him- for labor. Citation was duly issued añil sérved on 'áppelleé, properly returned, and filed in the justice court on May 22, 1930, citing the appellee to appear for trial on May 26th. On appearance day ap-pellee entered its appearance in the case and secured a continuance until the June term of said court.
