— Appeal by defendant from a judgment of the Supreme Court, Queens County (Savarese, J.), rendered October 20, 1978, convicting him of two counts of criminal sale of a controlled substance in the sixth degree, upon a jury verdict, and imposing sentence. H Judgment modified, on the law, by reversing defendant’s conviction under count one of the indictment, the sentence imposed thereon is vacated and said count is dismissed.
