OPINION

BUSSEY, Presiding Judge:

Appellant, Jimmy Rogers, hereinafter referred to as defendant, was charged, tried and convicted in the District Court of Tulsa County, Oklahoma, for the offense of Grand Larceny; his punishment was fixed at five (5) years imprisonment. Thereafter, the defendant filed an Application for Post Conviction Relief in the trial court which was denied on February 10, 1972, and from said denial of post conviction relief, a timely appeal has been perfected to this Court.
