Appeal from an order of the Supreme Court at Special Term, entered October 26, 1976 in Albany County, which granted partial summary judgment to plaintiff. State Equipment Corporation, a New York corporation, entered into a security agreement with defendant whereby defendant agreed to pay a certain amount for the purchase of an excavator. This security agreement was then assigned by State Equipment Corporation to plaintiff, a Pennsylvania corporation.
