MEMORANDUM OPINION
ARRAJ, Chief Judge.
On December 3, 1973, Plaintiff H. Bruce Franklin made application for one of two available faculty positions in the English Department at the University of Colorado. Although his application was one of several hundred submitted, the English faculty approved his appointment in January, 1974, by the “overwhelming” vote of twenty-six to five (one abstention).
