Appeal from a judgment of the County Court of Broome County (Mathews, J.), rendered January 29, 1999, upon a verdict convicting defendant of the crime of criminal sale of a controlled substance in the third degree.

Pursuant to an undercover investigation in Broome County, Mary Yurenda, a member of the State Police Community Narcotics Enforcement Team, made several undercover purchases of narcotics from an apartment located in the Village of Endicott, Broome County.
