Defendant, All American Life and Casualty Company, has moved for summary judgment under Rule 56 of the Federal Rules of Civil Procedure alleging in substance that there is no genuine issue as to the fact that James E. Hayman omitted to state and concealed from defendant insurer in his application for the life insurance object of this action, certain material facts which, had they been known to defendant, it would not have issued the policy.
