— In a proceeding pursuant to CPLR article 78 to review a determination dismissing the petitioner from his position, the appeal is from a judgment of the Supreme Court, Dutchess County, dated November 13, 1978, which granted the petition to the extent of directing that the petitioner be reinstated to his former position and remanded the matter for the imposition of a new penalty. Judgment reversed, on the law, without costs or disbursements, determination confirmed and proceeding dismissed on the merits.
