Plaintiff, Illiana Machine and Manufacturing Corporation (Illiana), sued defendant, Duro-Chrome Corporation (Duro-Chrome), for damages arising from a breach of contract for the alleged defective performance of chrome plating and polishing 20 steel retainers. DuroChrome denied that its work was defective and set forth two affirmative defenses: (1) Illiana is barred under the contract from asserting a claim since it did not notify Duro-Chrome of defects within a reasonable time; and (2) by accepting and paying for Duro-Chrome’s services without claiming any defect, Illiana is now estopped from…
