Appeal from a judgment of the Supreme Court, Erie County (Russell E Buscaglia, A.J.), rendered January 11, 2002. The judgment convicted defendant, after a nonjury trial, of grand *1195larceny in the fourth degree and criminal trespass in the second degree (two counts).

It is hereby ordered that the judgment so appealed from be and the same hereby is unanimously affirmed.
