ROBERT L. TAYLOR, District Judge.

This suit was instituted to recover damages for personal injuries resulting from a pistol shot on January 15, 1957, (at White’s Filling Station in Loudon County, Tennessee. Plaintiff is a citizen of Boston, Massachusetts, and defendant Godsey, a former policeman employed by the City of Loudon, is a resident of Tennessee, and the City of Loudon is a municipality created by the Tennessee Legislature. Jurisdiction of this court is based on diversity of citizenship.
