William Elam, appellee, filed a declaration in case against the Majestic Coal and Coke Company to the May term, 1908, of the Perry County Circuit Court, claiming damages for personal injuries to him alleged to have been caused by the wilful violation of section 16 of the Mines and Miners Act.
