The landlord instituted this summary proceeding alleging that the term of the tenancy had expired and that the tenants (who are husband and wife) hold over and continue in possession of the premises after the expiration of the term, without the consent of the landlord. The tenants and their children occupy an apartment in what is called the landlord’s “ Parkchester Development ”.

The petition contains the allegation “ That this proceeding is pursuant to O.P.A. Begulations, Sec. 6 (a) (3) (i) and Sec. 6(a) (3) (ii).” Annexed to the petition and made part thereof, is a letter from the landlord…
