Defendant was convicted of one count of arson and three counts *495of deliberate homicide in the District Court. From the judgment of conviction and the denial of his motion for a new trial, defendant appeals.

In the early morning hours of July 4, 1975, a fire occurred in an apartment house at 507-509 Fourt Street South, Great Falls, Montana. There were four separate apartments in the building, housing about ten people.
