HARRIS, Judge.

On March 2, 1970, Appellant was convicted for possession of drugs denounced by the Alabama Drug Abuse Law as set forth in Section 5(c) of Act No. 252, General Acts of Alabama, 1967, and was sentenced to a term of four (4) years in the penitentiary. He gave notice of appeal and requested suspension of sentence pending appeal. Sentence was suspended and bond fixed at $8,000.00. Being unable to make bond, he appeared in open court with his attorney on March 5, 1970, and withdrew his request for suspended sentence and was on that date ordered by the court to begin serving his…
