This cause is submitted on motion of plaintiff, appellee herein, for an order dismissing the appeal for failure to file assignments of error and brief with the transcript, and on motion of defendant, appellant herein, for an order permitting the assignments of error and brief heretofore filed to be docketed as filed within time.
