This is an appeal, on the part of the State, from' an order sustaining a demurrer to the indictment charging the defendant with disposing of property unlawfully, upon which there was a lien for labor.

The record states that Asbury White made a crop during the year 1905 as laborer, under contract with defendant. Under the terms of the contract, the defendant agreed to pay White one-half of all crops raised by him. White performed his part of the contract.
