The defendant obtained a judgment against the plaintiff in an action of assumpsit. This appeal followed the refusal of the court below to grant a new trial or enter judgment n. o. v.

The action grew out of a contract entered into between the plaintiff and defendant, who was to do certain work in and about a house to be erected for the plaintiff. Suit was brought by plaintiff, alleging that the defendant failed to comply with his oral contract, in that the work was not done in a careful and workmanlike manner, as a result of which plaintiff sustained damages to the extent…
