In a proceeding pursuant to CPLR article 78 to compel petitioner’s reinstatement to the position of village engineer, which position had been abolished, the appeal is from a judgment of the Supreme Court, Westchester County, dated September 17, 1979, which, inter alia, ordered petitioner’s reinstatement. Judgment reversed, on the law and the facts, with costs, and proceeding dismissed on the merits.
