OPINION

RESTANI, Judge:

John Lalor was arrested on January 30, 1990, following execution of a search warrant at his residence. He was charged with possession with intent to distribute cocaine, 21 U.S.C. § 841(a)(1), and use of a firearm in relation to a drug trafficking offense, 18 U.S.C. § 924(c)(1). On April 30,1991, after a hearing, the district court denied his motion to suppress evidence obtained during the search. On May 6, 1991, Lalor did not appear for trial, and in a superseding indictment was charged with an additional count for failure to appear, 18 U.S.C. § 3146(a)(1). On March 9,…
